Agreement to Terms of Use

This is a legally binding agreement. Please read these terms and conditions carefully.

The following are the Terms of Use provided by Prestige Health Solutions, LLC (“PHS”), doing business as SwyftScripts (“SwyftScripts”, “SwyftScripts Services”, “The Company”). By registering for use of the SwyftScripts™ web Platform and/or SwyftScripts™ mobile app, you acknowledge your agreement to be bound by the terms and conditions of this agreement. If you do not agree, do not use any of the SwyftScripts Services. SwyftScripts reserves the right to edit or modify, in any manner deemed appropriate by management, any parts of the Terms of Use. In continuing to utilize any of the SwyftScripts services should any changes be made, you accept and agree to any such changes.

The Platform is not intended to be a substitute for professional medical advice, diagnosis, or treatment, and the information in the Platform may not be complete or accurate. Always seek the advice of your pharmacist, physician, or other qualified health care provider with any questions you may have regarding a health condition. Never disregard professional medical advice or delay in seeking it because of something you have seen in the Platform.

As long as you comply with the Terms of Use, SwyftScripts grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Platform only as specifically set forth in this agreement and only for the services made available through the platform. The Pharmacy reserves for itself and its licensors any rights not expressly granted in this agreement.

Privacy

Please review our Privacy Policy, which is supplemental to this Terms of Use agreement and applies to all SwyftScripts Services.

Content

Content includes all software, data, graphics, text, and any other material on SwyftScripts. All Content is owned, licensed, or controlled by SwyftScripts and protected by intellectual property laws.

You may not copy, modify, reproduce, republish, display, or distribute any Content without prior written consent. Limited personal, non-commercial copies may be made if:
(a) no alterations are made,
(b) notices are preserved, and
(c) copyright/trademark legends remain intact.

You agree you do not acquire ownership rights through your use of the Platform. Any ideas or improvements you share with SwyftScripts automatically become its property.

Health-Specific Content

Any health-related content is for general reference only and not medical advice. Always consult your physician. For emergencies, call 911.

SwyftScripts is not a medical provider; it only connects physician orders to pharmacies for fulfillment and delivery. Reliance on health content provided is at your own risk.

E-Communications

By using SwyftScripts, you consent to receive communications from us electronically, including but not limited to emails, SMS messages, chat messages, push notifications, and phone calls. You agree that all such electronic communications satisfy any legal requirement that such communications be in writing.

Email communications may include, but are not limited to:

Appointment confirmations and reminders
Prescription updates and pharmacy notifications
Billing and payment information
Support responses and service updates
Marketing and promotional content (if you have opted in)

You are responsible for ensuring the email address associated with your account is accurate and up to date. SwyftScripts is not responsible for any missed communications due to outdated or incorrect contact information.

You may opt out of certain types of email communications (such as marketing messages) by following the unsubscribe instructions included in those messages. However, you may still receive transactional or service-related communications as long as your account is active.

Telephonic Communication

You authorize SwyftScripts to contact you via text, app, email, chat, or phone. By opting in to SMS, you agree to receive appointment reminders, instructions, billing notifications, and other relevant messages. Standard message/data rates apply. Reply STOP to opt out.

Links to Third-Party Sites

SwyftScripts may contain links to external sites. SwyftScripts is not responsible for the content, resources, or operations of third-party sites.

User Conduct

You agree to provide accurate information, act with integrity, and not disrupt SwyftScripts services. Prohibited activities include:

Fraudulent or illegal use
Hacking or reverse engineering
Harvesting or scraping user data
Offensive, threatening, or discriminatory behavior

User Account and Security

Certain services require an account. You are responsible for keeping your username and password secure. Notify SwyftScripts immediately of any unauthorized access. You are responsible for all activity under your account.

Account Use

You must use your account honestly and legally. SwyftScripts may suspend or terminate accounts with false or inaccurate information, or in cases of prohibited conduct. Termination may occur without notice, and SwyftScripts is not liable for resulting damages.

Disclaimers

SwyftScripts services are provided “as-is” and “as-available” without warranties of any kind. No guarantee of error-free or uninterrupted service is made. You assume all responsibility for use.

Limitations of Liability

SwyftScripts is not liable for indirect, incidental, or consequential damages resulting from use of its services. Any liability, if found, is limited to the amount you paid for the services.

Indemnification

You agree to hold SwyftScripts and its affiliates harmless from any claims or damages arising from your use of the services or violations of these Terms.

Dispute Resolution

These Terms are governed by Texas law, with jurisdiction in Harris County courts. Claims must be raised within one year. Disputes should first be addressed in good faith, then through mediation, before pursuing other remedies.

General Information

SwyftScripts may disclose content or records to improve services or comply with legal requirements. The Terms of Use and Privacy Policy constitute the full agreement.
